Two regulators, two sets of records, one set of consequences
Care providers carry a double compliance load that almost nobody else does. The CQC assesses whether your service is safe, effective, caring, responsive, and well-led. The Home Office assesses whether your sponsor licence records hold up. Get either wrong and you are facing enforcement, a failed inspection, or civil penalties of £45,000 to £60,000 per worker for illegal working.
The overlap is bigger than most providers treat it as. Recruitment files, right to work evidence, rotas, and training records all sit inside both regimes, and a gap found by one regulator is usually visible to the other. This joint checklist from Borderless and Quality Compliance Systems (QCS) handles them as one job rather than two.

Care compliance: your questions answered
Does the CQC check immigration compliance?
Not directly, but the two overlap. Recruitment records, safe staffing evidence, and training records are all inspected by the CQC and all form part of what the Home Office expects from a sponsor. A weakness in either place tends to show up in both.
Can a care provider lose its sponsor licence after a CQC inspection?
A poor inspection outcome does not revoke a licence on its own. What the sponsor guidance does say is that for every working location in England you must hold active CQC registration, or the worker’s application is refused and your CoS requests are rejected, and losing that registration means the licence is revoked (SK4.40 to SK4.45). The Home Office also makes checks with other government departments and agencies, and compliance action can rest on a poor record with them (Part 3, C7.4 and C7.6). In our experience, providers under CQC enforcement should expect closer attention.
How does a sponsor licence work across several registered locations?
One licence covers the organisation, not each service. The duties sit at organisation level even though the records are usually held at each location, which is the point at which providers with several locations most often lose a single view of what is on file.
Can care providers still recruit care workers from overseas?
Overseas recruitment for care workers closed on 22 July 2025. New sponsorship is limited to people already in the UK who either hold Skilled Worker permission as a care worker or senior care worker, or have worked lawfully for you in a care role for at least three months before the Certificate of Sponsorship is assigned. The displaced care worker pool is one of the main places to find them.
Who this checklist is for
Registered managers, nominated individuals, and the compliance or HR lead in a care organisation that sponsors. Providers running several registered locations under one licence will get most out of the overlap section, because a compliance visit can land at the service head office reviewed least recently.
