Compliance / Right to work checks

Every right to work check, recorded and followed up

Everyone you employ needs a right to work check before they start, and anyone with time-limited permission needs another before it ends. Your team carries out each check, and Borderless validates the evidence you upload, tells you when an Employer Checking Service check is needed, and books every follow-up.

Three ways to check

The right check for each person

The Home Office recognises three ways to check someone’s right to work. You can’t insist on a digital method, so your team needs to be ready for all three.

Online check

Home Office online check

For anyone with an eVisa. They give you a share code starting with W, valid for 90 days, and you view their status online and keep the result.

Manual check

Original documents

You check original documents from the Home Office lists, make a copy, and record the date you checked. An expired biometric residence permit isn’t acceptable.

Digital check

Registered digital provider

For British and Irish passports and Irish passport cards, a registered digital verification service provider can check the document, including passports up to six months past expiry.

The right check, then the follow-up booked

Pick the right check

The person’s status decides the method: an online check with a share code, original documents, or a digital check.

Borderless validates the evidence

Upload the share code result or document copy, and Borderless validates it straight away: valid, valid with a follow-up date, Employer Checking Service needed, or blocked.

Your adviser takes the tricky ones

Pending applications, unusual documents and anything unclear go to an IAA-regulated immigration adviser.

Saved, and the follow-up booked

The evidence is saved with its date, and anyone with time-limited permission gets a follow-up before it ends.

What the Home Office expects

A correct check is your defence

A right to work check done properly, before someone starts, gives you a statutory excuse against a civil penalty. These are the rules behind it.

Timing

Before day one

Every check must be complete before the person starts work, including each step of a manual check.

Follow-ups

Before permission ends

People with time-limited permission need a follow-up check on or before the day it ends. People with no time limit need one check.

Records

Kept for two years after

Keep each check securely for as long as the person works for you and for two years after, with the date it was done.

Since 1 October 2026

More people in scope

Checks now cover more than employees, including some workers, individual sub-contractors, and people found through online matching services.

Sponsors

Every sponsored worker

Sponsors must make sure every sponsored worker has a right to work check, whatever the working arrangement, and keep it with their Appendix D records.

Penalties

Up to £60,000 per worker

Employing someone without the right to work can mean a civil penalty of up to £60,000 per illegal worker. For a sponsor, it’s also likely to cost the licence.

Questions we’re often asked

Can Borderless do the checks for us?

No. Your organisation carries out each check and keeps the statutory excuse it gives you. Borderless validates the evidence you upload, guides you through an Employer Checking Service request when one is needed, and books every follow-up.

Is a biometric residence permit still enough?

No. The Home Office stopped issuing biometric residence permits on 31 October 2024, and a manual check of an expired one isn’t acceptable. Most people now prove their right to work with an eVisa, through the online check.

What if a worker’s permission ends while they wait for a decision?

If they applied before it ended, the Home Office can confirm the application is pending, which gives you a statutory excuse for six months. Your adviser checks the details, and the next check is booked.

How long do we keep right to work records?

For as long as the person works for you, and for two years after they leave. Then the copies should be securely destroyed. Borderless keeps each check on the worker’s file with the date it was done.
